Conveyancing is a vast and complex area of law that requires the  utmost diligence care and skill. The various entities that can be involved in the process are the Rates Clearance Department, The National Housing Finance Co operation , The Deeds Office, SARS, Bond Registration Attorney, Bond Cancellation Attorney. 

SIMPLE TRANSFER PROCESS :


1.The Purchaser and Seller signs the Offer to Purchase.

2 FICA verification of all parties concerned 

3. Rates Application will be submitted to the relevant Municipality for Rates Clearance Figures, once the figures has been received , Payment will follow , and the Rates Clearance Certificate will be issued.

4The Transferring Attorney will apply for the Transfer Duty Receipt .

5.Bond Cancellation , Transferring Attorney and Bond Registration Attorney will liaise with each other respectively.

6. Once all documents are drafted and so signed by ALL The attorneys , simultaneous lodgment will occur . 

7. Should the Registrar of Deeds require queries to be entertained, same will be referred back to the Attorneys and once the same has been resolved according to the specifications of the Registrar the lodgment will occur.



The above is a basic sketch of a so called simple transfer between a Seller and Purchaser.

The protection of this Act makes it possible for consumers to trade more confidently and freely .
